Investors Sue Porsche for $2.6 Billion Over Unsuccessful VW Takeover

The automotive world was taken by surprise on October 17, 2007, when Porsche CEO Wendelin Wiedeking announced in an interview on the Sunday Times that the Stuttgart sports carmaker was ready to take over VW.

Wiedeking expected the so-called “Volkswagen law”, which stipulated that no shareholder could have more than 20 percent of the voting rights of Europe’s number one car manufacturer, to be ruled illegal by the European Court of Justice.

However, things didn’t turn out as Wiedeking expected and in 2010, 18 hedge funds filed a US$2 billion lawsuit in the U.S. accusing the company and its former CEO (Wiedeking) and CFO (Holger Härter) for manipulating the market and trying to cover up the losses Porsche suffered after VW shares soared.

Now we learn that another group of investment funds, represented in Germany by the Broich Partnerschaft von Rechtsanwaelten law office is suing Porsche. The group is seeking around €2 billion (US$2.6 billion) in damages due to the company’s failed 2008 attempt to take control of VW that resulted in a €10 billion (US$10.3 billion) debt.

In a statement to the press, the investors accuse Porsche of “gaining control over the price of VW common stock as it secretly built enormous derivative positions covering almost all of VW's freely traded shares, then triggered a massive short squeeze, and finally released billions of euros worth of shares into the short squeeze for its own profit.”

Porsche spokesman Frank Gaube responded to the lawsuit by stating to Bloomberg News that “The accusations are not justified and we reject them”.

It should be noted that in 2009, Porsche and the Volkswagen Group agreed to combine, but their merger has so far been halted by the lawsuits that followed, because VW does not wish to be implicated until the issue is over.

2012 Toyota Land Cruiser 200 Facelift Breaks Cover in Japan

Toyota has officially revealed a refreshed version of its Land Cruiser 200 or V8 (not to be confused with the smaller Land Cruiser / Prado) in its home market of Japan, with most changes expected to pass on the global variant as well.

On the outside, the 2012 Land Cruiser 200 gains a boxier front bumper with new foglamps, redesigned headlamps with integrated LED strips on the lower side and a revamped front grille with chrome slats.

The new exterior mirrors with turning signals, along with the different tail lamp graphics and newly designed alloy wheels in sizes 18- and 20-in. complete the look.

Changes to the interior are limited to the graphics of the instrument panel, an improved TFT screen info placed between the two main gauges, and new colors and trim materials for the cabin.

On the technology front, Toyota has updated the Land Cruiser 200's Multi-Terrain Select system, which provides the ability to alter the settings of the traction control and ABS for different driving conditions, as well as the "Craw Control" feature that acts a bit like a cruise control for low-speed off-roading on difficult terrain.

The 2012 Land Cruiser 200 will continue to be offered in Japan with a single engine option, a 4.6-liter V8 delivering 318PS at 5,600 rpm and 460Nm (339.2 lb-ft) of peak torque at 3,400 rpm, linked to an automatic transmission and an all-wheel drive system.

Local prices range from 4,400,000 yen (~US$56,500) for the five-passenger GX model to 6,300,000 yen (~US$80,900) for the top-of-the-line, eight-passenger ZX.

Along with the regular models, Toyota also offers two special packages for the JDM 2012 Land Cruiser 200, named "Luxury SUV" and "Urban Sports", both of which add a number of bespoke styling elements inside and out.

Toyota didn't say when it plans to introduce the facelifted Land Cruiser in other markets around the world, but buyers should expect to see it in dealerships sometime next year.

2011 Nissan Rogue Subjected to Recall Over Power Steering Issue

More than 7,300 Nissan Rogue crossovers from the 2011 model year are being recalled after it was discovered that circuit board might not have been installed in the correct position on certain electric power steering (EPS) assist control units.

The National Highway Traffic Safety Administration [NHTSA] said that this may cause the circuit board to fail and as a result, the power steering assist feature will cease to function thus increasing the force needed to steer the vehicle.

The Japanese automaker said that the affected vehicles were manufactured from August 17, 2010, through October 30, 2010.

Nissan plans to notify owners for the safety recall before the end of December. If necessary, the firm's dealers will replace the EPS control on the affected Rogue models free of charge.
